Terms of Service

Please read these Terms carefully before using the Trike platform. By registering or placing a booking, you agree to be bound by these Terms.

1. The Parties

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Customer", or "Driver") and Trike Mobility (OPC) Private Limited (CIN: U49219TN2025OPC180057, GSTIN: 33AALCT8599F1ZP), having its registered office at 18, Kamaraj 1st Cross Street, Saligramam, Chennai – 600093, Tamil Nadu, India ("Trike", "we", "us", or "our"). By accessing or using the Trike platform (the web application or mobile application), you agree to be bound by these Terms. If you do not agree, do not use the platform.

2. Eligibility

  • You must be at least 13 years of age to use the platform.
  • Users between 13 and 17 years of age must have the consent of a parent or legal guardian, who accepts these Terms on their behalf.
  • You must provide a valid Indian mobile phone number capable of receiving OTPs.
  • By completing registration, you represent that all information you provide is accurate, current, and complete.

3. Service Description

Trike operates an on-demand electric vehicle logistics platform in Tamil Nadu, India, connecting customers who need goods transported with trained EV drivers who fulfil those bookings. Services include parcel delivery, cargo transport, and vehicle rentals. Trike is a technology platform — it does not itself operate vehicles or employ drivers as employees.

4. Account & OTP Authentication

  • Your mobile number is your account identity. You are solely responsible for maintaining the security of your account.
  • A one-time password (OTP) will be sent to your registered mobile number for sign-in and for delivery confirmation.
  • You must never share your delivery-confirmation OTP with anyone other than the assigned Trike driver, at the time of physical handover of your goods.
  • If you believe your account has been compromised, contact us immediately at support@trike-mobility.com.

5. Booking, Cancellation & Payment

  • All bookings are subject to driver availability in your area.
  • Fare estimates are calculated on distance, service type, and applicable GST. The final fare may differ from the estimate.
  • You may cancel a booking at any time before the driver picks up the goods without charge.
  • Cancellations after pickup are not permitted; you will be charged the full fare for such trips.
  • Payments are processed securely through Razorpay. We do not store your card details.
  • In the event of a fare dispute, contact support within 48 hours of the trip completion.

6. Prohibited Goods

You must not book Trike services for the transport of:

  • Hazardous, flammable, explosive, or radioactive materials.
  • Illegal goods, narcotics, counterfeit products, or items that violate any applicable law.
  • Live animals.
  • Human remains.
  • Currency, negotiable instruments, or high-value jewellery (above ₹10,000 declared value).
  • Perishable goods requiring temperature-controlled transport (unless a specialised service is explicitly offered).

Trike reserves the right to refuse or terminate any booking where prohibited goods are suspected, without refund.

7. User Responsibilities

  • Provide accurate pickup and drop locations. Incorrect location information causing trip failure will not be eligible for a refund.
  • Ensure goods are properly packaged and secured before handover to the driver.
  • Be present (or have an authorised representative present) at the pickup and drop points.
  • Treat drivers with respect. Abusive or threatening behaviour will result in immediate account suspension.
  • You may not book more than one active delivery at a time.

8. Phone Number Disclosure

Your registered phone number will be shared with the driver assigned to your booking to facilitate co-ordination. Trike does not currently use a phone number masking service. You expressly consent to this disclosure by placing a booking. Drivers are bound by their service agreement to use your number only for the purpose of fulfilling your booking.

9. Driver Obligations

  • Drivers must comply with all applicable traffic laws and safety regulations.
  • Drivers must complete deliveries promptly and handle goods with reasonable care.
  • Drivers must keep their vehicle, licence, and profile documents current and valid.
  • Drivers must not subcontract bookings to third parties.

10. Limitation of Liability

To the maximum extent permitted by law: (a) Trike's liability for loss, damage, or delay of goods in transit is limited to the fare paid for that booking; (b) Trike is not liable for indirect, consequential, or special damages; (c) Trike is not liable for events outside our reasonable control, including natural disasters, civil unrest, or third-party service failures. Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for fraud.

11. Intellectual Property

All content, branding, software, and technology on the platform is owned by or licensed to Trike Mobility (OPC) Private Limited. You may not copy, reproduce, reverse-engineer, or distribute any part of the platform without our prior written consent.

12. Suspension & Termination

We reserve the right to suspend or permanently terminate your account, without notice, if you breach these Terms, engage in fraudulent activity, or pose a safety risk. You may delete your account at any time from the "Data & Privacy" section in your profile.

13. Indemnification

You agree to indemnify and hold harmless Trike Mobility (OPC) Private Limited, its directors, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the platform, your violation of these Terms, or your violation of any third-party rights.

14. Privacy

Your use of the platform is governed by our Privacy Policy, which is incorporated into these Terms by reference.

15. Changes to These Terms

We may update these Terms at any time. We will notify you of material changes via in-app notification or SMS at least 7 days before the changes take effect. Continued use of the platform after the effective date constitutes acceptance.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising from these Terms or your use of the platform shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to binding arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed by mutual agreement, and the seat of arbitration shall be Chennai, Tamil Nadu. The courts of Chennai shall have exclusive jurisdiction over any matter not subject to arbitration.
